Why would we want to oversee this short-term claims process?

We want our clients to have a consistent claims process, a consistent calculation of damages and legal positions across the board, especially within any given property. It is our understanding that clients are getting inconsistent instructions from BP on how and where to file their claims. We want to reduce the confusion in the process so that our clients have a quick and relatively easy time with the short-term claims process.

We receive a fee only on the claims against the $20 billion Independent Escrow Fund (the “Fund”) and on your long-term claims against BP (and other responsible parties). This fee is calculated based on a contingency fee. We do not received a fee unless we obtain a recovery on your behalf. Any recoveries against the Fund are between 15% and 20%. If you do not receive an acceptable offer through the Fund we will file a formal claim against BP, and if necessary a lawsuit. Our fees for long-term claims or a lawsuit are on a sliding scale based on whether BP admits liability or whether we have to prove liability in Court.
